Tungol Law Victorious in an N-336, Request for Hearing in Naturalization Proceedings

Tungol Law was victorious in an N-336, Request for Hearing in Naturalization Proceedings, and obtained an approval on client's previously denied N-400, Application for Naturalization.

Client hired Tungol Law after receiving a denial of the N-400 application. The main issue is Client's "questionable lack of attachment to the Constitution of the United States." If the client refiles, the same issue would come up and garner another possible denial.

Requesting a hearing to reconsider the previously denied application was the most feasible way to move forward with a chance of approval. N-336 is a more complex hearing than the usual immigration interview. We utilized the caselaw that was most beneficial to our client, with the main one being: An applicant who is hostile to the basic form of government of the United States, or who does not believe in the principles of the Constitution, is not eligible for naturalization. (See Allan v.United States, 115 F.2d 804 (9th Cir. 1940). We argued that our client's actions and answers were not "hostile" in this sense, and the hearing officers agreed; thus ruling positively, and re-opening and approving the N-400 application right there on the spot.
