Washington, DC - Where others failed, Tungol Law prevailed in obtaining a most favorable decision; approval of an employment-based Schedule A immigrant petition, wherein the prevailing wage had expired by time of filing the petition with U.S. Citizenship and Immigration Services (USCIS), but the ad posting was current and still within the validity period of a normal PERM filing period. USCIS routinely denies such filings, and many caselaw and precedence have ruled in favor of USCIS. However, Tungol Law provided the winning argument that led to the most elusive approval for this type of fact pattern.
